Terms of Service
These terms apply to orders placed with Fruityland Ice Cream Corporation and to your use of this website. By placing an order you agree to them.
Ordering
- Submitting the checkout form sends us an order request. It is not an accepted order until we confirm it by email or phone.
- We confirm every order against what is actually in the case that day. If an item is unavailable we will offer a substitute or remove it and tell you the new total.
- Please give us accurate contact details. If we cannot reach you to confirm, we may have to release the slot.
Prices, tax and payment
- All prices are in US dollars (USD) and apply to sales in Chicago, Illinois.
- Sales tax of 10.25% is added at checkout, as required for Chicago, Illinois.
- This website does not take payment. You pay at pickup or on delivery by card or cash. Catering and wholesale orders may be invoiced on request.
- We may change prices and menu items at any time. The price confirmed in your order email is the price that applies to that order.
Pickup and delivery
- Pickup is free at 4610 N Kedzie Ave, Chicago, IL 60625, United States.
- Local delivery is available within 5 miles of the shop. Minimum order $25.00 before tax; delivery is $6.99 and free on orders over $75.00.
- Delivery times are estimates. Weather, traffic and order volume can move them; we will call if we are running late.
- Frozen products need to be received in person. If nobody is available at the address, the order may be returned to the shop for pickup, and the delivery fee is not refunded.
Allergens and ingredients
Our kitchen handles milk, eggs, wheat, soy, peanuts and tree nuts. Items containing nuts are labeled on the menu. If you have an allergy, tell us when you order so we can pack items separately, and read the label on the container before eating. Our menu descriptions are a summary, not a full ingredient list; ask us for the ingredient sheet for any item.
Website use
- The content, photographs, text and layout of this website belong to Fruityland Ice Cream Corporation or are used with permission. Please do not republish them commercially without asking.
- Do not attempt to disrupt the site, submit fraudulent orders, or scrape it at a volume that affects other customers.
- The site is provided as is. We keep it accurate and online, but we do not promise uninterrupted availability.
Limitation of liability
To the extent permitted by Illinois law, our liability for any claim connected with an order is limited to the amount you paid for that order. Nothing in these terms limits rights you have under Illinois consumer law.
Governing law
These terms are governed by the laws of the State of Illinois, United States, and disputes will be handled by the courts of Cook County, Illinois.
